TERMS AND CONDITIONS
THE AGREEMENT is between you ("Client") and Benrishi Enterprises, LLC ("Contractor"). When you accept our Quote or tell us to start working, you agree to the following Terms and Conditions. By hiring us, you agree that you have read and understood these Terms.
1. WHAT WE ARE DOING AND THE QUOTE
1.1 The Work: We agree to do the electrical work listed in the Quote we gave you. If you want to change anything from the quote, we need to agree on it in writing, and the price might change. 1.2 Quotes Expire: Our quotes are good for 30 days. After 30 days, we might have to change the price if materials or labor costs change.
2. GETTING READY FOR WORK
2.1 Letting Us In: You need to make sure we can easily get into the work area during our scheduled hours. 2.2 Move Your Stuff: We will take efforts to protect your property and possessions, but please move your furniture, electronics, and any fragile items out of the room before we start. This is your responsibility. 2.3 If Stuff Gets Damaged: We will be careful, but we aren't responsible for damage to things you didn't move out of the work area.
3. PAYING US
3.1 When to Pay: Payment is due as soon as we finish the work. If the job takes several days, we might ask for partial payments along the way. 3.2 Late Payments: If you don't pay on time, we may charge interest. If we have to hire a lawyer or a collection agency to get paid, you will have to pay their fees too. 3.3 Mechanics Liens: State law allows us to place a mechanics’ lien on your property if we are not paid for our materials or labor. Nothing in this contract should be read to limit or prevent us from exercising such rights under state law. 3.4 Who Owns the Materials: Any parts or fixtures we install belong to us until you pay the bill in full.
4. OUR PROMISE (WARRANTY)
4.1 Our Work: We promise our work will be done professionally and in a workmanlike manner. We guarantee our labor for a year. 4.2 What isn't Covered: This guarantee doesn't cover problems caused by bad weather, misuse, accidents, Acts of God, or if someone else tries to fix our work. 4.3 Parts Warranty: The parts and fixtures we install are covered by the manufacturer’s warranty, not ours. If a part fails and we must replace it, we will give the part to you so that you may make a warranty claim with the manufacturer in your individual capacity as property owner.
5. LIMITS ON LIABILITY
5.1 Extra Damages: We aren't responsible for indirect losses, like lost profits, lost data, or business interruptions. 5.2 Maximum Payment: If something goes wrong and we are found responsible, the most we will pay is the amount you paid us. 5.3 Old Wiring: We aren't responsible for fixing or paying for damage caused by old, broken, or dangerous wiring that was already in your structure before we got there.
6. YOUR RESPONSIBILITY
If you break these Terms and Conditions, or if your negligence causes a problem, you agree to cover our costs (including legal fees) for any claims or damages that result. This explicitly includes problems caused because you didn't clear the room as asked in Section 2.2.
7. UNCONTROLLABLE EVENTS
Sometimes things happen that we can't control, like severe weather, supply shortages, refusal of the city to issue permits, or strikes. If these things delay our work, we aren't responsible for the delay.
8. CANCELLING OR RESCHEDULING
8.1 Notice: We understand things come up. If you need to cancel or reschedule, please tell us at least 48 hours before we are scheduled to start. 8.2 Fees: If you cancel or reschedule with less than 48 hours' notice, we may charge a cancellation fee to cover our lost time.
9. PERMITS AND INSPECTIONS
9.1 Paperwork: If the electrical work is part of a project involving multiple trades (framing, plumbing, electrical, etc), you are the acting general contractor. You may enter our Ohio Electrical Contractor #50832 in your filed paperwork. Inspections: If the inspector finds a problem with our workmanship, we will, of course, fix it at no additional cost. Sometimes, a city inspector might require extra changes to your existing wiring that weren't part of our original plan or part of the work performed by us. If this happens, the additional work will cost extra.
10. SURPRISES BEHIND THE WALLS
10.1 Hidden Problems: We can't see inside your walls until we open them. If we find dangerous wiring, code violations, or structural issues that we didn't know about, we will stop and talk to you. 10.2 Extra Costs: Fixing these hidden problems isn't included in our original quote and will cost extra.
11. DANGEROUS MATERIALS
If we find dangerous materials like asbestos or lead paint, we must stop working immediately for everyone's safety. You will need to hire a specialist to remove the danger before we can resume our work.
12. PHOTOS OF OUR WORK
We love to show off our good work! We may take photos of the finished electrical project to use for quality control purposes, or on our website or social media. We promise not to include any photos of your family or any personal details that would identify your specific address.
13. HANDLING DISPUTES
13.1 Mediation and Bench Trial Only: If we have a disagreement that we can't resolve by talking, we agree to try mediation first. This means a neutral third party (a mediator) will help us try to work it out. If mediation fails, we can take the matter to court, but we both agree to have a bench trial only. This means a judge will decide the outcome, and we both explicitly give up our right to a jury trial. 13.2 The mediation or bench trial will take place in Butler County, OH. 13.3 We both want to resolve disputes efficiently. Under Ohio Revised Code Chapter 1312, you are required to provide us with written notice of any defects at least 60 days before you file any lawsuit. This gives us the chance to fix the issue, pay for it, or dispute it without getting lawyers involved. If you file a lawsuit without giving us this required notice and opportunity to cure.
14. THE LAW
14.1 State Laws: These rules are governed by the laws of Ohio. 14.2 Fairness: If a court decides one part of this agreement is invalid, the rest of the agreement still stands.
15. PAYMENT OPTIONS
We are happy to accept cash, checks, Zelle, or Venmo. We can also accept credit cards, but because of the fees charged to us, we add a 3% surcharge to the total if you choose to pay with a card.
